Two arrested in San Marcos convenience store shooting

SAN MARCOS, Texas (KXAN) — Two men have been arrested after a shooting outside a San Marcos convenience store early last week.

David Labelle, 29, was arrested for aggravated assault with a deadly weapon, a second degree felony. He was taken into custody last Friday at his home in the 300 block of Craddock Avenue. Labelle is being held in the Hays County Jail on a $50,000 bond.

Police say Labelle got into an argument with another man outside of Sunny’s Food, located at the intersection of Old Ranch Road 12 and Craddock Ave. The argument escalated and that’s when police say Labelle pistol-whipped the victim. “The next thing we know we just heard a gunshot and once we heard a gunshot, me and the customer ran to the restroom and that’s where we called 911,” said Oscar Alcantara, a store employee.

The victim was not injured during the shooting, but did have minor injuries from being hit by Labelle.

Labelle then got into a car with a man Ricardo Fonseca, 21, and drove away. Fonseca has also been arrested for unrelated warrants of injury to a child/elderly with bodily injury out of Caldwell County.

Police say tips through social media helped detectives track down the suspects.
