APD: No refusal until ‘end of summer’

AUSTIN (KXAN) – The Austin Police Department announced they will conduct an extended enforcement of the No Refusal program which will end after Labor Day.

APD is conducting an extended no refusal program from 9 p.m. Friday, August 21 until 5 a.m. Thursday, September 3, 2015 which will then be followed by a Labor Day DWI initiative.

“No refusal” means that should a suspect refuse to provide a breath or blood sample, and the officer has evidence of impairment, the officer shall apply to a judge requesting a search warrant for a blood sample.

The details for the Labor Day initiative are still being finalized and will be released soon. While that effort will include an Austin no refusal component, it will also be a Regional DWI effort including multiple jurisdictions.
