ROUND ROCK, Texas (KXAN) — Police have charged a Round Rock man with capital murder in the death of a 3-year-old boy. Christian Javier Rodriguez, 20, was booked into the Williamson County Jail on Wednesday.

Paramedics were called to a home in the 1400 block of East Logan Street about 12:30 a.m. Sunday after learning about a child who was not breathing. EMS pronounced Andres Tapia dead at the scene. Rodriguez admitted to throwing the child, Round Rock police say, and that resulted in serious bodily injuries and the child’s death.

“The family was devastated,” one neighbor said. “I spoke to the grandma and grandpa and the mom, and they were just completely devastated … the mama just got home from work.”

The neighbor, who wanted to remain anonymous, says she has never seen signs of trouble.

“He would just be playing. He would run around and he would always say ,‘Hi’ … He was just a fun-loving beautiful child.”

She had no idea police arrested Rodriguez, the mother’s boyfriend, on Wednesday on a capital murder charge.

“For someone to have hurt this child makes me sick to my stomach,” the neighbor said. “Breaks my heart.”

According to Rodriguez’s and the mother’s Facebook pages, they have been together about a year.

Rodriguez also commented Tuesday on the mother’s Facebook saying, “You are an incredible mom and were Andres’ everything. Just know he is now in heaven with God and one day y’all be reunited. I love you so much. We’ll get thru this.”

Child Protective Services is investigating the death but added that they had no prior involvement with Tapia or the child’s parents. CPS says the mother did have another baby, and that child is currently in family placement. provides commenting to allow for constructive discussion on the stories we cover.
