AUSTIN (KXAN) — Police have charged a man with capital murder following the Nov. 25 shooting of 31-year-old Lequince Tomlin inside an East Austin apartment.
According to an arrest affidavit, two men ‘bum rushed’ their way into a unit at the Walnut Creek Apartments on Springdale Road and asked for Tomlin, who had been sleeping on a living room couch. The two other people in the apartment were ordered to get on the floor as one of the suspects took money from Tomlin at gunpoint. As the two men were leaving the apartment, one of them shot Tomlin, the affidavit said.
The two suspects had their faces partially covered, but one witness said he knew who the two men were and recognized their voices. He told police that the two were Allen and ‘Bro’, and they stayed in the apartment above them, the document said.
The woman living upstairs said Allen and ‘Bro’, later identified as 25-year-old Terry Lynne Stowers Jr., were at her apartment the night of the shooting.
A witness inside the apartment where the shooting happened was later able to identify the two men in a photo lineup, according to police.
Stowers was booked into the Travis County Jail on Saturday.
An arrest warrant was also issued for 26-year-old Allen Keith Townsend Jr. on capital murder charges. He has not yet in custody, according to jail records. The woman Townsend was staying with told police she saw Townsend change into black clothing and ask for a bandana the night of the shooting. She also overheard a phone conversation in which Townsend was asking someone for a gun, the affidavit said.
