Teen could face a lifetime in prison over pot brownies

WILLIAMSON COUNTY, Texas (AP/KXAN) — A 19-year-old from Round Rock is facing five years to life in prison – for making and selling pot brownies.

Round Rock police officers showed up to Jacob Lavoro’s apartment in the Colonial Village Apartment complex on April 14 after one of his neighbors called in to complain she could smell marijuana coming from his apartment and she was concerned for her health, according to the police report.

Now, Williamson County prosecutor Travis McDonald said Lavoro is facing five years to life in prison for what authorities found in his apartment.

After they received permission from Lavoro’s girlfriend, who lives with him, to come in and search, police found several grinders and pipes, hash oil, marijuana cigarettes, loose marijuana, pot brownies and cookies and a total of $1,675 in cash scattered throughout the apartment. In total authorities found a little less than 145.85 grams of hash oil, 16.02 ounces of marijuana, and 660.69 grams of pot brownies and cookies, according to the police report.

After arresting Lavoro, authorities searched his phone and found text messages with several people to sell the pot brownies. Lavoro admitted to authorities he buys the marijuana and hash oil, which he then mixes with vegetable oil and cookie or brownie mix to sell pot brownies and cookies for $25 each, according to the police report.

Authorities said hash oil is a controlled substance with much harsher state penalties than marijuana. The oil has higher concentrations of the psychoactive component of the marijuana. It’s in a penalty group with amphetamines and ecstasy.

But Lavoro’s attorney, Jack Holmes, said Lavoro is being charged for the weight of the brownies as a whole, which other baking products and came out to about 2 lbs. in total, instead of the THC content in the batch which was about 2 to 3 grams. Holmes argues this would make it a first degree felony instead.

Lavoro was charged with manufacturing and delivering a substance, possession of marijuana, and possession of a controlled substance. He will be in court on June 19.
