APD enforcing ‘No Refusal’ on Mardi Gras

AUSTIN (KXAN) — APD will enforce a “no refusal” initiative on Mardi Gras Saturday, March 1 and Tuesday, March 4 from 9 p.m. to 5 a.m. on both days.

Under Texas Implied Consent Law, the “no refusal” initiative means anyone arrested for a DWI must give a breath or blood sample. All drivers, by simply getting on the roads, will be considered to have given consent to providing a breath or blood sample. If a driver doesn’t provide a voluntary sample, then an officer will apply for a search warrant from a judge or magistrate to obtain it.

According to APD, the initiative is an effort to enforce DWI laws, keep the public safe and conduct blood search warrants on suspects who refuse to give a breath or blood specimen as required by law.
